Terms & Conditions

PLEASE ENSURE YOU READ AND UNDERSTAND THE FOLLOWING TERMS AND CONDITIONS PERTINENT TO YOUR ACCOMMODATION RENTAL.  IF YOU HAVE ANY QUERIES, PLEASE DO NOT HESITATE TO CONTACT US.  (HEREAFTER CALLED THE OWNERS) FOR CLARIFICATION BEFORE YOU SIGN THE BOOKING FORM

Whilst we reserve the right to increase or decrease accommodation prices at any time.  We will confirm to you the current price at the time of booking.  As soon as you have confirmed your booking and paid our deposit or full payment, the cost of the rental is guaranteed against any further increase.  This guarantee is offered subject to our terms and conditions and payment being adhered to and providing you do not make further amendments to your holiday arrangements

Your holiday home rental includes Accommodation as booked, including services e.g. Water and Electricity, (excludes pool heating unless otherwise stated).

NOT included in our rental prices:

  1. BulletFlights

  2. BulletCar Hire

  3. BulletHoliday Insurance

  4. BulletPool Heating

  5. 1.Bookings are valid after:

  6. a.The booking form has been completed and signed and received by the Owner and

  7. b.The appropriate deposit had been paid and

  8. c.The booking has been confirmed in writing by the Owner and the Guest

  9. 2.The person, who signs the Booking Form, certifies that he/she is authorized to agree the Booking Terms and Conditions on behalf of all persons included on the Booking Form, including those substituted or added at a later date.  The signatory must be a member of the party occupying the property and must be 21 years or over.  Bookings cannot be accepted from parties of your people under 21 years of age.

  10. 3.A Deposit of 25% of the total booking must accompany bookings, which is non-refundable.  Upon clearance of the payment the booking will be confirmed.

        The balance must be paid ten weeks prior to the commencement of the holiday

  1. 4.A Security Deposit of $400 is required in addition to the final balance paid 10 weeks prior to your arrival.  We shall hold said Security Deposit until the premises have been inspected upon the Guest’s departure.  The premises will be inspected both before and at the end of the each rental.  Although the property will be cleaned after you departure it is the responsibility of the guest to ensure it is left in an orderly manner,  Should the property be deemed to require extensive cleaning then the owners, management company reserve the right to withhold any monies from the security deposit to pay for extra cleaning. Once it is determined that the property is in a satisfactory condition and no excessive use of utilities the Security Deposit, will be returned to yourselves 28 days after your departure

  2. 5.The Guest is solely responsible for any damage or breakages beyond “wear & tear” that may be caused to the property and/or its contents, and also for any loss of items in the inventory during their stay.  Upon arrival, the Guest should immediately report any damage to the premises to the Management Company.  Examples of such damage might include, but are not limited to, broken windows or blinds, torn screen on lanai, burn marks on counters of furniture, appliance problems, major stains etc. If damage is reported that costs in excess of £$400 we reserve the right to claim this off the Guest.  The management company will endeavour to replace or rectify any loss or damage to the property or its contents, or resolve any problems you may have as soon as practically possible

  3. 6.The Guest is responsible for the safe return of the key for the property, and that the property is fully secured on their departure.  If the key is not returned or is lost, the cost of changing the locks will be deducted from the Security Deposit

  4. 7.Charges for damages, losses or any maintenance of repairs to the premises, equipment, amenities or fixtures, or any cleaning services over and above the normally required to prepare the villa for the next guests which are necessitated by misuse of extraordinary uncleanliness, will be at the discretion of the Management Company and will be deducted from the Security Deposit.

  5. 8.“In the event of damage of any kind to the property or excess cleaning costs or excessive us of electricity(e.g. leaving external doors open with air conditioning on) which exceed the Security Deposit, the signatory will be held responsible for all additional costs”  Air conditioning will ONLY work effectively when all the doors and windows are fully closed and if you reduce the temperature on the thermostat by a few degrees then give the system enough time to reach the new temperature 75 to 80 degrees should be comfortable.  The system should NEVER be set lower than 72 degrees as this will cause the system to freeze up and stop working altogether (for which you will be charged).  The system is very effective when used properly

  6. 9.Trash bins are collected once a week, the actual days are listed in the property. Our County has a recycle policy and to help with this there are specific recycle bins, full details are in a pamphlet in our homes.  The trash must be placed in trash bags and securely tied and placed in the bins provided at the side of the property, recycling is places in yellow recycling container.   The bins should be placed at the front of the drive, close to the road edge no earlier than the evening before collection, the bins must be returned to the side of the property no later than the evening of the collection day.  Heavy fines are imposts by the County for any trash that is loose or the bins not stored away.  If a violation notice is issued by the county, the guest will be liable for any fines incurred.

  7. 10.For your own security and the safeguard of our home, do not allow any unidentified persons into the home.  If in any doubt please call the management company to check their identity and authorisation of any maintenance/pest control  or cleaning staff.

  8. 11.Our home is protected by a monitored security system, this does not only act as a burgular alarm, but is also a monitored fire/smoke alarm.  It is therefore REQUIRED that the guest makes all members of their group aware that all doors and windows must be locked, including garage doors, the front door and all doors leading to the pool area and the alarm is activated whenever the home is left unattended.

  9. 12.This rental home is designated as a “NO SMOKING” home and all Guests agree to refrain from smoking inside the house.  In the event that neutralization of smoke odors from cigarettes, cigars, pipes or other smoking materials is required, or in the event that burn marks from such smoking materials are detected, the cost for elimination of those odors or repair of the burn marks will be deducted from the Security Deposit.

  10. 13.We reserve the right to treat the booking as cancelled if we do not receive the balance by the due date.  Any cancellation charges detailed elsewhere in this document will then apply.

  11. 14.In the event of a cheque/check not being honored by the bank on which it is drawn we will make a charge of $30 to cover the bank charges and our administration costs.

  12. 15.If the Guest wishes to cancel the booking he should advise the Owner immediately by telephone followed by confirmatory letter.  The Owner shall be entitled to retain all payments already made (except the Security Deposit) and to recover, if not already paid, the balance of the hiring charge as follows:

  13. After deposit is paid to confirm booking, This is NON-REFUNDABLE.

  14. 30-60 days notice: 50% of the rental charge

  15. Less than 30 days notice: 100% of the rental charge

  16. 16.In the unlikely event that circumstances beyond the Owner’s control necessitate the cancellation of the rental arrangement, the Owner reserves the right to cancel any bookings at any time and will only be liable to refund monies already paid by the Guest.  Furthermore, it is possible that some construction work may take place in the area of new homes.  The Guest should establish the status of development prior to booking.

  17. 17.No liability is accepted by the Owner for loss of main services or failure of appliances, nor the consequences of the actions or omissions of persons who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by the Owner.

  18. 18.Unlike most rental homes who offer free local calls, we have found more and more guests like to keep in touch with home and offices.  For this reason we are pleased to offer a FREE NATIONAL & INTERNATIONAL CALLING PLAN.  We have decided that the normal costs per stay do not exceed that of $10, so we have used this as our basis of costs.  We have a summery of costs available to see near the telephone to guide you in your calling costs. A predefined amount has to be placed with the supplier, this will not be your balance to spend, but for our assistance in costs.  Your balance is set out as above.  We are notified every time a call is made and the costs involved.  If however you anticipate you will use more than your alloted costs, please notify us and we will discuss you plan and costs.  We reserve the right to deduct from your Security Deposit costs incurred over your alloted plan and costs that are determined as chargeable.  (Please make sure to check the country list first for chargeable calls.)  Instructions of use are available near the telephone and country costs available in our vill  folder.  PLEASE NOTE: Although every attempt will be made to make sure this service is in good working, it is provided as a free service and we will not be held responsible if the service is unavailable for any reason.

  19. 19.A SONY playstation 2 has been provided free of charge for use by the Guest.  This system includes the main unit (which also serves as a DVD player), two controllers and a few games.  Guests are responsible for the proper use of the PS2 system and its various components.  If, when an inventory is completed upon Guest’s departure, it is noted that any games or components of the system missing, the cost to replace the missing items will be deducted from the Security Deposit.  (2 Playstations, 2 controllers @ Highlands Reserve. 1 Playstation and 1 controller @ Hampton Lakes

  20. 20.Hampton Lakes property is equipped with a laptop computer as a complimentary facility.  We ask that you do not attempt to load any software of download files from the internet.  The computer is checked for misuse after every guest leaves, and any evidence of tampering will be reported to the owners.  This facility is provided free of charge, and as such we cannot be responsible if this facility is unavailable.

  21. 21.The property is available after 4.00pm on the day of arrival and must be vacated by 10.00am on the day of your departure.  Failure to comply with this may result in a full days extra costs rental charges which the Guest agrees to pay.

  22. 22.Although every effort is made to ensure that the rental villa is in superior condition, neither the Owners, the Management Company, nor their agents, shall be held responsible for any third party claims, accidents, damage to or loss of property, or for any expenses incurred for any reason, including changes caused by Force Majeure, regardless of how they may have occurred, nor can liability be accepted by the Owners, Management Company, or their agents, for injury to anyone as a result of the use of the pool, however caused.  Upon arrival at the rental villa, the Guest should note the pool rules and regulations that have been posted, a copy of which is available upon request.  Guests are specifically advised not to allow unsupervised children into the pool area.  Rendering the pool door alarms inoperable on the patio doors, leading from the house to the patio/pool area is illegal and strictly forbidden.  The Guest is responsible for taking out an adequate insurance policy(ies) to cover all risks.  This waiver is also applicable to people visiting our property as guests of the Guest(s),

  23. 23.The Owner does not accept any liability for injury, damage or loss caused, or for any such claim by a third party as a consequence of actions by the Guest(s) and other people occupying the property during the period of the let.

  24. 24.An additional fee of $36 per day will be levied if the Guest requires the pool to be heated during their stay.  This price is agreed with a prebooking only, if the Guest requires pool heat on arrival a charge of $41 per day will be levied for the duration of their stay, and payment is required in cash the day the pool heat is switched on.  Guests may use the swimming pool at their own risk.  They should always observe the safety rules listed in the information and safety book held in the home and observe the pool safety notice displayed in the pool area.

  25. 25.There are pool door alarms on all doors and windows that lead/look onto the pool area. These alarms must not be turned off, tampered with or in any way disabled.  This is a US state requirement and will result in a $5000 fine if not adhered to.

  26. 26.Pool Heating will be switched on, on the day ordered and may take some time to heat the pool to optimum temperature.  Having ordered pool heating.  The Owner is not responsible for the weather and , if it’s warmer than expected, pool heating still has to be paid for.  This also corresponds to cold weather. The pool temperature is dependant on the prevailing weather conditions.  The solar blanket must be used at at times when the pool is not in use. (especially at night) or the heater will not function correctly. 

  27. 27.The heater is a mechanical device, as with any mechanical device it can be subject to electrical/mechanical failure.  If such an occurrence was to happen, every effort will be made to repair the heater.  If the Guest had paid for pool heat, then we shall refund only the days you are without pool heat.  We cannot and will not refund for anything that has not been paid for.

  28. 28.The pool is cleaned and chemically balanced every week for your safety and comfort, however on rare occasions it may be necessary to apply extra chemicals to the pool to maintain safe and correct chemical levels. Should this occur during your stay it will be necessary for you to be out of the pool for a period of 12-24 hours for safety reasons.

  29. 29.As Owners of the property, we, our servants, or agents, will not be liable for any loss or delay occasioned by any of the following:

  30. strikes

  31. riots

  32. political unrest

  33. war or threat of war

  34. terrorist activities

  35. industrial disputes

  36. fire

  37. flood

  38. technical/weather problems to transport/aircraft

  39. closure of airports or any other event beyond the owners control

  40. 30.The maximum occupancy is 8/Highlands Reserve & 10/Hampton Lakes persons for the villa and it determined by the authorities within strict guidelines for fire safety.  Please note that contravention of the above will render your booking void, all monies will be forfeited and you will be asked to leave the villa immediately without further compensation.

  41. 31.Strictly no pets or smoking are allowed in the vill at any time. Please note that contravention of this rule will render your booking void and all monies will be forfeited.

  42. 32.Our villa is situated in a quiet residential area consisting of approximately 50/50 rental homes/US families.  It is a condition of the rental that you should be considerate in your behaviour and keep noise levels to a reasonable level so as not to disturb our neighbours.

  43. 33.Complaint: We sincerely hope you do not have any!.. But in the unlikely event that you wish to register a complaint during your holiday, contact the property management company immediately and follow this up with a letter.  Give a copy to them and send us a copy on your return.  Unfortunately we are not always able to control the components of your rented accommodation and it is possible that an advertised facility may be withdrawn or changed due to circumstances beyond our control and for which we cannot accept liability

  44. 34.British citizens travelling on the visa waiver scheme and staying for less than 90 days should hold a full British machine readable passport, which is valid for at least 90 days following their entry to the US. Completed an online ESTA approval to travel via the US Homeland Security Website. All other nationalities should contact the US Embassy for further information.

WE STRONGLY ADVISE ALL OUR GUESTS TO TAKE OUT ADEQUATE TRAVEL INSURANCE FOR YOUR WHOLE PARTY, WHICH INCLUDES CANCELLATION CHARGES COVER (UK GUESTS ARE ALSO ADVISED TO TAKE OUT A POLICY WHICH INCLUDES MEDICAL COVER) AS SOON AS YOU HAVE BOOKED ANY PART OF YOUR HOLIDAY/VACATION.  IF YOU CHOOSE NOT TO DO THIS. YOU NEED TO BE AWARE THAT YOU WILL BE PERSONALLY RESPONSIBLE FOR PAYMENT OF ANY CANCELLATION CHARGES WHICH MAY BECOME DUE.
